I agree that option B is the correct choice. They are looking for you to have a stable residency, so having it established as the application time nears makes the most sense. Still, I would consult with an expert or an attorney if you have the opportunity.

Did u call USCIS customer service and raised a service request for not receiving FP?. If not I guess you need to do that
We filed for adjustment of Status in August 2006 and received EAd's and travel documents. We have not yet received fingerprint dates. Will it take this long? Any advise on how to deal with this?

Hi Gurus,
My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.
There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

Hi,
I've read conflicting information on whether one is eligible to receive unemployment benefits.
Specifically, i understand as a primary applicant in AOS status, one can not claim such benefits. But how about a derivative spouse, working on EAD , who lost her job? Can she claim such benefits as unemployment insurance. I've read that unemployment insurance should NOT be construed as a public charge, since its paid by the employer , when the employee is working.
So is it safe to get the basic unemployment benefits for a derivative spouse working in AOS status?

you can search some good online universities to join her and change her status to F1.She can do MBA or Masters through some accredited online university,so that she can attend classes online no need to go anywhere.
If you try in this route she can get her CPT/OPT so that she can work,
and will achieve masters degree finally,which will help to find a sponsor easily.
If u want to persue that job which is offering you bright future,may be this is the option u can use to maintain the status of your wife.

While parents apply for a tourist visa, in DS-156 where it says "who will pay for the trip", if they mention "self" do we still have to send an Affidavit of Support.
Secondly, do they have to show sufficient cash in their bank account for the trip or will investment proof be ok.
Thirdly, our extended visa is expiring 28thApr'07 & we've applied for renewal in feb'07. We have n't received the receipt yet. Will our current visa copy be sufficient ?

Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.
So your answer should be. "I need H1B sponsorship to work."

YES! EAD is your license to work for any company, even for those not sponsoring you. It doesn't matter if your i140 is approved or not, you can work with EAD and that is legal.

My question is I got my education credentials evaluated last year for H1B filing. but I missed last year's H1B quota and applying again this year.
Do my last years evaluation report is scuffiscient or do I need fresh evaluation of my education credentials?
How long the education evaluation report is valid Once evaluated?
